Prototype Terms

These terms apply to the BoardFlow website, interest list, public demo and current prototype. They do not create a paid subscription, guaranteed pilot place, production-ready service or commitment to launch particular features.
1. BoardFlow
BoardFlow is operated by Carlos Montenegro, sole proprietorship, KVK 96085819, Tuigerstraat 60, 1033 PH Amsterdam, the Netherlands. Contact: carlos.montenegrovela@gmail.com.
2. Development status and access
BoardFlow is an evolving prototype. Features, interfaces and data formats may change, fail or be removed. The demo uses fictional information. Non-demo projects currently rely on shared links and access information rather than individual user accounts. You are responsible for keeping project links and access information private and for ensuring that everyone you share them with is authorised.
We may limit, suspend or end prototype access where reasonably necessary for security, maintenance, misuse, legal compliance or product changes. Joining the interest list does not reserve access, set a price or promise a launch date.
3. Your projects and responsibilities
You retain ownership of scripts, images, production records and other material you submit. You give BoardFlow a limited permission to host, copy, transmit and technically process that material only as needed to operate, secure and improve the prototype.
You must have the necessary rights and lawful basis for everything you add, including crew and cast information. Do not upload unlawful material, special-category personal data, material that infringes another person’s rights, or confidential production information that is unsuitable for the prototype’s current access model. Maintain your own current backup of important work and verify schedules, call sheets, contact details and exports before relying on them.
4. Feedback
If you voluntarily provide product ideas or workflow feedback, BoardFlow may use them to evaluate and improve the product without payment or attribution. This does not transfer ownership of your scripts, films, existing materials, confidential information or other intellectual property.
5. Acceptable use
You must not misuse the website or prototype, bypass access controls, seek access to another project, interfere with operation, introduce malicious code, scrape or overload the service, impersonate another person, or use BoardFlow for spam or unlawful activity. You must report suspected unauthorised access promptly and cooperate with reasonable protective measures.
6. BoardFlow ownership
The BoardFlow name, software, website design and original content belong to BoardFlow or its licensors. You receive only a limited, revocable, non-exclusive right to use the website, demo and prototype for evaluation and your authorised production planning. No right to resell, sublicense, reverse engineer or commercially exploit BoardFlow is granted, except where mandatory law permits otherwise.
7. No professional or operational guarantee
BoardFlow does not replace professional production judgement, safety planning, legal review, emergency procedures or independent verification. It does not guarantee data availability, uninterrupted access, accurate calculations, successful exports, delivery of messages, or that a production plan is complete or safe. The service is provided on an “as available” basis during development.
8. Liability
Nothing in these terms excludes liability, privacy rights, GDPR compensation rights or consumer protections that cannot legally be excluded or limited. Subject to those mandatory rules, BoardFlow is not liable for indirect or consequential loss, loss of opportunity, production delay, loss or corruption of data, or unauthorised access caused by a shared project link or access information.
For business users, and only to the extent Dutch law permits, BoardFlow’s aggregate liability arising from the free website, demo or prototype is limited to €100. This limitation does not apply to intentional misconduct or deliberate recklessness by BoardFlow.
9. Privacy
The Privacy Notice explains how information is handled. It does not reduce any rights or duties imposed by applicable privacy law. Before BoardFlow is used to process personal data on behalf of a production or customer, the parties must enter any processor agreement required by Article 28 GDPR.
10. Ending use
You may stop using the website or prototype at any time and may request deletion as described in the Privacy Notice. Provisions that by their nature should continue—such as ownership, responsibility for submitted material, liability limits and governing law—remain applicable after use ends.
11. Law and disputes
Dutch law governs these terms. Disputes are handled by the court competent under applicable law. Mandatory consumer rights, including any right to bring proceedings elsewhere, remain unaffected. Contact us first at carlos.montenegrovela@gmail.com so we can try to resolve a concern practically.
12. Changes
We may update these terms as BoardFlow develops. Material changes affecting existing prototype use will be communicated where reasonably possible. Continued use after an effective update means the updated terms apply, except where the law requires another form of agreement.
